       Versus
  State of Maharashtra and Others

 
Mr. Gaurang Vora  a citizen of Sion,  Mumbai filed the present petition seeking directions to the concern authorities to implement the Noise Pollution (Regulation & Control) Rules, 2000 and the order of Hon’ble Supreme Court of India passed in Writ Petition (Civil) No. 72/1998 ( In RE: Noise Pollution with Forum, Prevention of Environment and Sound pollution V/s. Union of India & Others ).  The petitioner contended that, despite comprehensive order passed by the Hon’ble Supreme Court bursting of loud firecrackers, use of exceptionally high volume loud speakers and musical instruments day and night continue to persist.  He further sought directions to implement the orders of the Supreme Court strictly.

MPCB submitted an affidavit outlining the various measures taken by it to create awareness amongst the masses particularly during the festive seasons.   The role of  MPCB in implementation of the rules vis-a -vis  the role prescribed authority (Police Department) was brought to the notice of the Hon’ble Court.

After hearing all the parties,  the Hon’ble Court disposed of the matter by an order dated March 22, 2007.  The Hon’ble Court referred an order passed in a similar matter (Janhit Manch & Others  V/s The State of Maharashtra & Others reported in 2006 (2) Maharashtra Law Journal, 284) wherein the Chief Secretary of the State was directed to issue instructions to all the concern authorities to implement the orders of the Supreme Court .  The same order was reiterated by the Hon’ble Court.
