    Biomedical Waste Management - Directions issued to common BMW T&D facilities

Sub: Direction u/s. 5 of Environment (Protection) Act, 1986 for Non- Compliance of conditions of Authorisation granted under the Bio- Medical Waste (Management & Handling) Rules, 1998
(as amended).
WHEREAS, Maharashtra Pollution Control Board has granted you authorization under the provisions of Bio-Medical Waste (Management & Handling) Rules, 1998 for operating Common Treatment Facility. AND WHEREAS, Central Pollution Control Board has stipulated guidelines for common bio-medical waste treatment facilities, wherein detailed specifications have been outlined for various unit processes and also operational part of common facilities.

AND WHEREAS, the Board had constituted a committee, to evaluate the performance of common BMW treatment and disposal facilities, functioning in the State. The said committee has visited these common facilities and has reported that generally the incinerators at the common facilities are not operated as per the operational specifications and no temperature recorders are provided to the incinerators to verify the operational compliance.

AND WHEREAS, the committee has also reported other non-compliances related to proper segregation of waste, inconsistent collection mechanism from individual generators, proper record keeping etc. at the common facilities.

AND WHEREAS, the Board has earlier issued public notice directing all health care units generating BMW in the state to obtain authorization and also join common facility, if treatment and disposal is not provided individually. In such a scenario, the proper operation and maintenance of common treatment facility becomes crucial, as the waste inflow is bound to increase substantially.

NOW THEREFORE, in exercise of the powers conferred on the Board, under Section 5 of Environment (Protection) Act, 1986, the following directions are given for compliance.

2 Improve the waste collection mechanism to ensure that waste is received/collected from individual generation in specified time limit 2 months
3 Provide temperature recorder to the incinerator 1 month
4 Improve the record keeping at the facility 15 days
5 Provide necessary effluent treatment at the facility 2 months
6 Provide infrastructure and facility to treat all categories of BMW at the facility 3 months

Your action plan for improving the operation and infrastructure at the facility alongwith a Bank Guarantee of Rs. 50,000/- shall reach to this office within 15 days with a copy to respective Regional Office. In case of your failure to comply with the above directions as well as conditions of Authorisation, appropriate legal action including cancellation of authorization and closure of your facility besides prosecution shall be initiated under the provisions of Environment Protection Act, 1986 & Bio-Medical Waste (Management & Handling) Rules, 1998, which please note.
